Upon reflection, in the time since the retreat, Robert had second thoughts about stepping away from chairing the planning working group and asked Jane if she would cede that role to him, to be shared with Sophie. Jane agreed”,

François Bregha moved (Céline Heinbecker seconded) adoption of the minutes of the June Board meeting, the Board retreat (as amended) and the August working group meeting. Carried

1. Councillor’s report / Compte-rendu de l’échevin

Mr. Bédard reported as follows:

• The artwork, that was part of the renovation of Sandy Hill park, has been installed. It will be officially unveiled at the September BBQ.
• A developer is proposing to build a condominium tower on an empty lot close to the corner of Rideau and Augusta. Mr. Bédard will arrange a meeting between ASH and the developer.
• Two four-story condominia are proposed for Robinson Village. They would require the tearing down of some existing buildings but fit within zoning rules.
• Claridge is negotiating the construction of Phases 2 and 3 of its Rideau St development (at Cumberland) with the City Design Committee.

1. Issues raised from the floor

• Can residents ask for the installation of four-way stop signs? These stop signs are erected based on traffic volume and accident records. Janice Bernstein will consult John Verbaas and propose at the next Board meeting that ASH write a letter to the City proposing specific new stop signs in Sandy Hill.
• Can pedestrian crossing at King Edward and Laurier be made safer? Current traffic volumes may not justify an all-way pedestrian crossing, followed by traffic crossing.
• What is the purpose of the pylons on the Lees ave bridge? They redirect traffic while work is being done to strengthen the bridge structure that has been corroded by salt.
• How does the Councillor spend his budget? The information is available on the City website.

6. Advocacy activities

85 Range Rd.

An OMB hearing took place on July 26 and approved the building design and site plan that had been negotiated by the developer and the community. The OMB Adjudicator asked that the developer consult the community before the site plan was finalised. The developer is also awaiting proposals for community benefits that it might fund. Jane Gurr has agreed to draft a note on lessons learned from the experience for future reference.

362 Templeton

ASH and area residents met City officials to express their concern about the conversion of a single-family dwelling into a de facto rooming house. They learned that as long as fire regulations were respected and minimum space per occupant provided, there was very little that they could do. They remain concerned about the possible deterioration of a large property as a result of reduced upkeep.

Laurier House

Drawings for the new visitor centre are available for viewing.

Beautification committee

The committee continues to meet monthly. It has approached Bed and Breakfast establishments for their support and is seeking a price estimate to post signs encouraging neighbours to keep Sandy Hill beautiful. It has also asked for community input on where new City garbage cans could be installed and will ‘adopt’ Laurier ave for two years (The City will place a sign to this effect soon). The Committee is also trying to set up a meeting with the Bylaw office to understand better how complaints about community standards are handled.

Heritage

Céline and Mona will develop ideas on how to engage students under the University’s Experiential Learning Program.

7. Community-building activities

Community BBQ

The date is likely to be September 19. The University and the SFUO have agreed to contribute to the event. The program will include food, music, display tables and the unveiling of the artwork in the park. SFUO will publicize the BBQ in an email it will send incoming students. Janice Bernstein needs additional volunteers to help organize the event.

All-candidates debate

The debate will take place on September 30 or October 5. ASH is recruiting a moderator and has received several expressions of interest from other community organizations and the SFUO to co-sponsor the debate.

8. Organisational activities

Financial report

ASH will have $3900 (excluding a GIC) in the bank after having paid for the artwork in the park (with a City grant). Judy Vincent proposed that Board members could incur expenditures of up to $100 (supported by receipts) without prior Board approval and should talk to her and seek Board approval for expenditures above $100.

Robert Stehle noted that he would like ASH to set up a Community Renewal and Development Fund to be allocated to community improvements.

Board voting procedures

It was agreed that the Board should make decisions outside its monthly Board meetings as the need arises, using the following procedure:

• A Board member would propose a motion, seconded by a colleague, explaining the rationale (where required) and giving a reasonable deadline for the vote.
• Board members should vote by replying to all in their email so that the vote is transparent.
• The vote will carry if a majority votes in favour and eight or more Board members vote.
• Such votes will be recorded in the minutes of the next scheduled Board meeting.

Board membership

Ryan Kennery is leaving the Board as he has moved to the City’s west end but is willing to volunteer some of his time. ASH could ask the University’s ELP if a student with the appropriate skills would be prepared to take on the role of director of communications for ASH.

Robert moved (Céline seconded) that the Board accept Jill McFarlane and Mona Staples as new members. Carried.

Membership recruitment

Janice Bernstein reminded Board members to start their door-to-door canvassing and set a deadline of October 31 to complete the areas assigned. She suggested that Kyle help François and John help Jane.

New academic year

Ted outlined the activities planned for incoming students in the first week of September and identified which were open to the community as a whole. He will circulate a full list to Board members.

Question :

La vente d’alcool sur une propriété privée est-elle illégale?

Réponse :

À moins d’être muni d’un permis de circonstance, la vente d’alcool sur une propriété privée est, en vertu de la Loi sur les permis d’alcool, illégale. Le paragraphe 5(1) ne stipule aucune amende établie. La personne est sommée à comparaître devant le tribunal en vertu de la partie 3. Le paragraphe 30(1) n’indique aucune amende établie pour avoir délibérément fourni de l’alcool à une personne âgée de moins de 19 ans. Le paragraphe 30(8) stipule qu’une amende de 105 $ est encourue si la personne âgée de moins de 19 ans a de l’alcool.

Question :

Est-ce illégal de boire dans des endroits publics (c.-à-d. sur le trottoir, dans la rue)?

Réponse :

D’après le paragraphe 31(2) de la Loi sur les permis d’alcool, quiconque a un contenant d’alcool ouvert ailleurs que dans un débit de boisson, une résidence ou un lieu privé commet une infraction; le contrevenant se voit infliger une amende de 105 $. D’après le paragraphe 31(4) de cette même Loi, l’intoxication dans un endroit public est également une infraction et est passible d’une amende de 55 $. N.B. À moins qu’elle ne refuse de s’identifier, une personne ne peut être arrêtée pour les infractions ci-dessus. Elle reçoit une contravention similaire à celles données pour les infractions au Code de la route.

Question :

Qui est tenu responsable lorsqu’une personne assiste à une fête privée et, subséquemment, se blesse dans un accident (en raison de son état d’ébriété)?

Réponse :

Il s’agit d’une affaire civile : la police ne s’en mêlerait pas. Le ou la blessé(e) devrait alors poursuivre la personne qui a fourni l’alcool. ACS : En Ontario, de nombreux jugements récents de la cour ont, selon les faits inhérents à chaque cas, reconnu les hôtes comme partiellement responsables.

Question :

Le fait d’uriner en public constitue-t-il une infraction? Qu’en est-il pour l’intrusion sur une propriété privée?
Réponse :

Uriner en public est une infraction au règlement 498-2003 de la Ville d’Ottawa sur l’utilisation et l’entretien des routes. Uriner ou déféquer sur une voie publique va à l’encontre de l’article 3 (1)(n) et est passible d’une amende de 105 $. Encore une fois, une personne ne peut être arrêtée pour pareille infraction; une contravention est habituellement donnée. Rien ne peut être fait si la personne refuse de s’identifier.

L’intrusion sur une propriété privée est une infraction à l’article 2(1)(a)(ii) de la Loi sur l’entrée sans autorisation. Un policier ou l’occupant des lieux ou une personne autorisée par l’occupant peut, sans mandat, arrêter la personne qu’il ou qu’elle croit, sur des bases raisonnables, contrevenir à l’article 2 de la présente Loi.

Question :

Quelles sont les sanctions possibles contre quelqu’un pris à faire un graffiti?

Réponse :

En vertu du paragraphe 430 (1) du Code criminel du Canada, le graffiti serait traité comme un méfait. Commet un méfait quiconque volontairement, selon le cas : a) détruit ou détériore un bien; b) rend un bien dangereux, inutile, inopérant ou inefficace; c) empêche, interrompt ou gêne l’emploi, la jouissance ou l’exploitation légitime d’un bien; d) empêche, interrompt ou gêne une personne dans l’emploi, la jouissance ou l’exploitation légitime d’un bien. Cette infraction, punissable sur déclaration de culpabilité par procédure sommaire, est passible d’emprisonnement pour un terme n’excédant pas deux ans. Les tribunaux n’envoient en réalité personne en prison; la sanction normale est la restitution financière équivalant au coût des dommages encourus.

Question :

Veuillez fournir des exemples de « troubler la paix » pour lesquels la police interviendrait (c.-à-d. casser des bouteilles de vin ou de bière dans la rue, sur le trottoir ou sur une propriété privée; bagarre ou dispute; grande fête bruyante; lancer des poubelles ou des bacs de recyclage dans la rue).

Réponse :

Le paragraphe 175(1) du Code criminel du Canada, « Troubler la paix », se lit comme suit : Est coupable d’une infraction punissable sur déclaration de culpabilité par procédure sommaire quiconque, selon le cas : a) n’étant pas dans une maison d’habitation, fait du tapage dans un endroit public ou près d’un tel endroit : (i) soit en se battant, en criant, vociférant, jurant, chantant ou employant un langage insultant ou obscène, (ii) soit en étant ivre, (iii) soit en gênant ou molestant d’autres personnes. Les tribunaux traitent également ceci comme une infraction mineure : la personne est habituellement condamnée à une absolution inconditionnelle (aucune sanction, aucun casier judiciaire) ou conditionnelle (comporte certaines conditions comme, par exemple, ne pas troubler la paix pour une période de temps déterminée; la personne qui se conforme à ces conditions s’en tire sans casier judiciaire).

La personne qui casse des bouteilles de vin ou de bière dans la rue pourrait également être accusée de méfait; la quantité de bris devrait cependant être substantielle au point de nuire à l’emploi légitime du bien. Le sergent Ralph n’était au courant d’aucune instance où pareille accusation avait été portée. Un juge froncerait probablement les sourcils devant une accusation de cette nature. Une personne pourrait toutefois également, en vertu du règlement 498-2003 de la Ville d’Ottawa, être accusée d’avoir jeté des déchets sur une voie publique; l’amende pour ce type d’infraction est de 105 $.

Question :

Veuillez nous guider sur ce qui constituerait un comportement suspect justifiant un appel à la police. Une personne devrait-elle, par exemple, appeler la police si elle voit un étranger marcher sur la propriété d’un voisin (et qu’elle sait que celui-ci est en voyage)? Devrait-elle appeler la police si elle est témoin d’indices laissant croire qu’une activité criminelle se déroule (c.-à-d. une transaction de stupéfiants)?
Réponse :

On devrait appeler la police dès qu’un comportement semble inhabituel dans le quartier, que ce soit une personne assise dans une voiture devant une résidence pour une longue période de temps ou une transaction suspecte. Les exemples mentionnés ci-dessus justifieraient un appel à la police.

Question :

Quelles sont les sanctions en ce qui a trait à un feu à ciel ouvert dans une cour ou un parc?

Réponse :

Les feux sont interdits, mais il faudrait communiquer avec le Service de pompiers pour connaître le type de sanctions.

Question :

À l’heure actuelle, quelle est la loi concernant la consommation de cannabis? Qu’est-ce qu’un résident peut faire si un groupe de jeunes est manifestement en train de vendre/d’acheter du cannabis devant chez lui?

Réponse :

La possession de cannabis/marijuana est toujours illégale, mais la mise en accusation est habituellement à la discrétion du policier – cela dépend habituellement des circonstances reliées à chaque situation. Il est peu probable qu’une accusation soit portée contre une personne qui n’a qu’un joint en sa possession; le joint serait par contre confisqué. Un résident témoin de gens qui consomment du cannabis/de la marijuana devant chez lui peut appeler la police. S’il est témoin de gens vendant/achetant des stupéfiants, il devrait appeler la police et tenter d’obtenir le plus de renseignements possibles à propos de la transaction (c.-à-d. le type de véhicule, le numéro de la plaque d’immatriculation, la description des gens impliqués).

Le Theatre under the Stars (Théâtre sous les étoiles) nous revient avec une excitante 24^e saison de théâtre d’été primé.

La série des Youth Matinees dans le parc offre une version d’une heure de la pièce, adaptée pour les jeunes de 5 à 12 ans.

Politique du parc Strathcona : Les « portes » ouvrent 30 minutes avant le début du spectacle. Politique en cas de pluie : À moins qu’il ne pleuve à verse en début de spectacle, ce dernier se poursuivra. Si l’on doit annuler, « un billet de pluie » sera émis. Ce billet est valide pour toute autre représentation du même spectacle, mais vous devrez appeler à l’avance pour réserver votre place.

• Art in the Park, le samedi 7 août de 10 h à 17 h

Exposition d’art où plusieurs marchands présentent des créations locales et recueillent des fonds pour la Société de la schizophrénie. Au programme de la journée : encan silencieux, BBQ et rafraîchissements. Entrée GRATUITE. Remis au dimanche 8 août en cas de pluie.

Qu’est-ce qu’une Marche-déchet? En bref, les gens qui ont une heure de libre le dimanche se rencontreront, munis de gants en plastique et un sac/seau, et ramasseront les déchets le long d’un trajet choisi par le groupe dans le quartier. Nous pouvons aussi prendre note des propriétés où il y a beaucoup de déchets et en parler aux propriétaires (si nous les connaissons), ou bien demander à la Ville de le faire (surtout dans le cas des propriétaires qui ne demeurent pas dans le quartier).

Quand et où allons-nous nous rencontrer?

Nous proposons nous rencontrer, pour la première Marche-déchet, chaque dimanche à 16h devant la Maison Laurier (au coin des rues Laurier et Chapel).

1. Councillor’s report / Compte-rendu de l’échevin

The Councillor reporgted as follows:

• • King Edward Avenue will be closed between Besserer and Laurier for most of the summer for water and sewage work. During that time, northbound traffic will be redirected towards Nicholas and Waller. One lane of southbound traffic will remain open.
  • Traffic calming measures will be implemented on Friel and Chapel during the summer.
  • Mr. Bedard invited ASH to take a formal position on the proposal to extend a City by-law to control inappropriate behaviour on City streets and sidewalks. SFUO opposes this proposal.

• ACTION: Robert Stehle will meet SFUO to understand their concerns and seek to reach a consensus. He wsill draft a proposal for an e-mail vote by the Board by May 26.

• • Mr. Bedard sought the views of ASH on a proposal to make it easier for the City to fine leaseholders and, in the case of repeated offences, landlords, for excessive noise complaints.
  • Mr. Bedard would like ASH to support the construction of a pedestrian bridge across he Rideau River at the foot of Somerset St.

5. Issues raised from the floor

• • The rehabilitation of sewers in Robinson Village is raising concerns about the noise of the generators.
  • What are the obligations of businesses in relation to litter and garbage?

• ACTION: Kahryn McCallion will draft a list of questions for City staff to determine the parameters within which residents can help keep the neighbourhood clean. Mr. Bedard’s office will establish the appropriate contacts with City staff.

• • When will the City post a sign in Sandy Hill park that it is reconsidering the right of residents to let dogs off-leash in the park? This sign should be going up any day. While the consultations are expected to be difficult, there are increaing signs of use conflict in the park.
  • Concerns were raised about the parking associated with the proposed Shoppers’ Drug Mart on Rideau St. and the upkeep of its landscaping on Besserer St.

6. Advocacy activities

Beautification committee

The committee held its second meeting last week amd is recruiting volunteers. It is identifying priority actions to pursue, including how to raise the profile of its activities. It will work with the University to recruit students to its work.

Heritage

ASH is working with the organisers of Jane’s Walk to organise 2 walks through Sandy Hill on May 2 starting from All Saints Church (11 am for the English walk; 1 pm for the French walk).

There was some discussion about ASH funding a history of Sandy Hill (in written form or on film) but it was agreed that ASH would only be able to fund a portion of such a project.

The Steering Committee continues to meet regularly. It has hired a planner and a lawyer to advise it and is preparing to negotiate with the developer in advancew of an OMB hearing scheduled for July. It appreciates trhe support it has received from Mr. Bedard.

Interprovincial bridge

The current study phase will end in June with the formal environmental assessment of the 3 current options to start in the Fall. Given that none of these options may remove most of the truck traffic on King Edward, a number of community associations are asking the NCC to include a fourth option in its study phase to cover the possibility of building a tunnel from the Macdonald-Cartier bridge to Nicholas.

MOTION: ASH supports the inclusion of a tunnel option in the environmental assessment of an interprovincial bridge (John Verbass proposes; François Bregha supports; motion carried).

Membership recruitment

Janice Bernstein explained the purpose of the proposed canvass of the enighbourhood and distributed information on how to conduct it. She will drop off supporting materials at the Community Centre for pick-up and has started to assign routes to Board members. She will email additional information and is inviting Board members to do as much canvassing as possible before the AGM.

AGM

François Bregha asked Board members to show up by 6 pm the day of the AGM to help set up. He outlined the status of various planning activities and suggested that the AGM planning committee meet once more prior to the AGM. It was agreed that ASH should not name a Volunteer of the Year unless it can find a truly-meritorious candidate.

9. Additional items

• Robert Stehle will replace Kathryn McCallion on as ASH representative on the FCA.
• François Bregha reported on an inter-faith poverty audit he had attended on behalf of ASH.
• Robert Stehle gave special thanks to Giulio Maffini and Kathryn McCallion who are retiring as directors for all the work they had done for ASH.
